RULE: 4 – OVWT – HEAVY OR OVERWEIGHT CARGO – LCL/FCL Eff: 10JAN2023

The application of Heavy Lift or Overweight cargo will be governed by the
following provisions, conditions and charges:
     
1. CARGO TENDERED TO CARRIER IN/ON OCEAN CONTAINER EQUIPMENT:
  a. Cargo, subject to the rates, charges and provisions named in this
     Tariff Rate Section, when tendered to Carrier already loaded in/on
     ocean containers or other transporting equipment (except as otherwise
     described in paragraph 1.b. below) will NOT be subject to any Heavy
     Lift or Overweight Charges.  However, Carrier reserves the right to
     refuse to accept any shipment loaded in/on a COL, SOL or underlying
     VOCC container or equipment that is:
  
    1) loaded beyond its marked weight capacity; OR
  
    2) without manufacturers plate clearly showing the specification of the
        container, including its maximum weight capacity; OR
  
    3) when Shipper fails to declare the gross weight of the loaded
        container.
  
     Any fines or penalties imposed as a result of the misapplication or
     misstatement of actual weight(s) on the B/L and/or other Shipping
     Documents provided by Shipper will be for the account of the cargo.
  
  b. All cargo and equipment is subject to being weighed.  In the event a
     Shipper Loaded shipment (cargo and equipment) exceeds the lower of (a)
     the Maximum Payload plus Tare weight of equipment as stated on the
     equipment’s CSC plate, or (b) 70,000 pounds, or (c) equipment
     specifications outlined herein or (d) exceptions otherwise stated
     within this Rule below or on a specific Web Rate Page; the Shipper (or
     Consignee for freight collect shipments) will be contacted and must
     select how to proceed based on one of the following options:
   
    1) The entire shipment is to be returned to Shipper (or its designated
       facility) to be reworked at its cost, subject to applicable drayage
       charges, if applicable.  
  
    2) If Carrier is requested to transfer the overweight portion of the
       shipment to be loaded into another piece of equipoment (SBJ
       to exclusive use).  Carrier will assess the following charges for
       such overweight portion:  
      a. Carrier will assess a Handling Charge of USD250 per each PC20 or
          PC40 container, and: 
      b. Carrier will assess an additional Ocean Freight Charge of USD250
          per each 2000 lbs. or fractional portion thereof, and:  
      c. All applicable assessorial charges for Shipper loaded equipment
          into-onto which the cargo is loaded will be assessed (for
          example: Handling, Landing, Bunker Surcharge, etc.).  
   
    3) Where Carrier offers less-than-containerload service for such cargo,
        Carrier will unload the overweight portion of the shipment, and
        move such portion in non-exclusive equipment pursuant to Carrier’s
        published tariff rate for less-than-containerload cargo, plus an
        additional Carrier Handling charge of USD250.00.  In such cases of
        Carrier Loaded cargo, Carrier will not load more than the weight
        limits set forth in this Rule.  Whenever Shipper tenders cargo
        which exceeds such weight limit,  Carrier will load cargo up to the
        limit allowed, and any excess cargo will be handled and charged for
        as set forth herein, subject to a maximum charge equal to the
        applicable Carrier Loaded FCL rate for the equipment onto which the
        cargo is loaded.
  
  c. CARGO TENDERED TO CARRIER IN A BREAKBULK, LOOSE OR UNCONTAINERIZED
     FORM OR IN PACKAGES, CARTONS, CRATES, D OR E CONTAINERS OR ON PALLETS:
     Except as otherwise provided on individual Web Rate Pages (TLIs),
     cargo that is subject to the rates, charges and provisions named in
     this Tariff Rate Section, when tendered to the Carrier in a breakbulk,
     loose, uncontainerized form or in packages, cartons, crates, D or E
     containers or on pallets will NOT be SBJ to any applicable Heavy Lift
     Charges and will be accepted without special arrangement PROVIDED the
     weight of EACH individual piece, package or unit in the shipment does
     NOT exceed 2000 lbs.  Shipments containing individual pieces,
     packagesin breakbulk, loose, uncontainerized form or in packages,
     cartons, crates, D or E containers or on pallets or in any other
     uncontainered form, which weigh in excess of 2000 lbs. will be
     accepted by the Carrier for transportation ONLY after special
     arrangements and prior booking have been accepted by Carrier.  Shipper
     MUST provide a complete description, including gross weight, of all
     articles exceeding 2000 lbs. at the time cargo is booked with Carrier,
     AND, will be SBJ to the Overweight Charges named below, which charge
     shall be in addition to all other applicable rates anc charges named
     in this Tariff Rate Section.
     
     LCL CARGO OVERWEIGHT CHARGES:  Breakbulk Cargo, Loose Cargo, Packages,
      Cartons, Crates, D or E Containers, Pallets or any Uncontainerized
      Cargo pieces weighing:
  
    1) Over 2000 lbs. but not weighing over 2250 lbs. will be SBJ to a
         an additional Overweight Charge of. . . . . USD 250.00
  
    2) Over 2250 lbs. will be SBJ to an additional Overweight Charge for
         each 250 lbs., or fraction thereof, which is in excess of 2250
         lbs. of:
          . . . USD 32.00 PLUS the additional charge named in c.1)
